Welcome to Sevendesk.ca, operated by Sevendesk IT Services Inc. (“Sevendesk”, “we”, “our”, or “us”), headquartered at 1409 Collip View SW, Edmonton, Alberta, Canada.

These Terms and Conditions govern your use of our website and the services we provide. By accessing our website or purchasing any service, you agree to be bound by these terms.

BY ACCESSING OR OTHERWISE USING THE SERVICES, YOU AGREE TO THESE TERMS & CONDITIONS IN THEIR ENTIRETY. Any person or entity who interacts with the Services through the use of crawlers, robots, browsers, data mining or extraction tools, or other functionality, whether such functionality is installed or placed by such person or entity or a third party, is deemed to be using the Services and bound by these Terms & Conditions. If at any time you do not accept all of these Terms & Conditions, you must immediately stop using all or any part of the Services.

SERVICE PACKAGES

We currently offer the following services to individuals and businesses in the following packages:

  1. Lightweight Tech Support (Monthly): We provide a lightweight plan for ongoing tech guidance and basic break-fix support, typically resolved within 15 minutes. This Service is limited to 20 support queries per month.

  2. On-Demand Business IT Helpdesk: We provide one-time or hourly break-fix support for home or office-based businesses. Monthly office-based plans are also available.

  3. Managed IT services: Our Managed IT service takes care of your office computers—from user accounts to patching Windows vulnerabilities and from providing tech support to ensuring your data is always securely backed up.

  4. Microsoft 365/Google Workspace Setup: This encompasses the setup and management of your Microsoft 365 or Google Workspace, including domain/email configuration.

  5. Microsoft SharePoint Setup & Support: We offer the development of tailored SharePoint sites for your internal technical documentation, standard operating procedures (SOP), user guides, end-user training materials training and Sharepoint support.

  6. Customized PDF Forms: This includes the creation of fillable, interactive PDF forms to streamline your data collection and simplify user interactions.

Note: We may update service descriptions over time. Please check our website for current offerings.

ELIGIBILITY AND USER RESPONSIBILITIES

To access our services, you must meet the following criteria:

  1. Be at least 18 years of age or the legal age in your province or territory.

  2. Provide accurate and complete personal or business information.

  3. Maintain the confidentiality of your login credentials.

  4. Notify us of any technical issues or service concerns.

  5. Submit requests or issues via our designated helpdesk system.

     

HOW TO ACCESS OUR SERVICES

When you visit our site and decide to engage with our services. To get started, you can select the desired subscription plan on the website and check out with a credit card to purchase your desired subscription plan. Future onboarding forms may be introduced later to collect additional information to tailor service delivery.


 

PRICING, TRIALS AND PAYMENT

We offer our services under the following billing models:

  1. Monthly Subscription: This includes a 3-day trial on the Personal Tech Support plan. After the trial, the subscription renews automatically unless cancelled.

  2. One-time and Hourly Services: Pay-as-you-go pricing for specific support needs.

Payments
We accept major debit/credit cards (Visa, Mastercard, American Express, Discover, Diners, CUP,JCB and Maestro) and digital wallets (Apple Pay, Google Pay, Tap to Pay on iPhone, Ideal, Pay now by Klarna, Pix and Boleto) via Wix Payments.

CANCELLATIONS AND REFUNDS

  • Subscription Plans: You may cancel your subscription at any time before the next billing cycle. No refunds will be issued for the current period once charged.
     

  • On-Demand Tech Support: Covered under a “No Fix = 100% Refund” policy if we are unable to resolve your issue.

DATA AND BACKUPS

You are responsible for:

  • Maintaining your own data backups.
     

  • Managing and securing your own passwords.

     

We may offer backup solutions in the future.

 

OWNERSHIP OF WORK AND CONTENT

  1. Client Deliverables: Customized services (e.g., PDF forms, SharePoint sites) are owned by you, the client.

  2. Website Content: All branding, designs, text, and other intellectual property on Sevendesk.ca remain the exclusive property of Sevendesk IT Services Inc.

We may showcase completed client work in our portfolio, but only with your oral or written permission.

SERVICE AVAILABILITY FROM THIRD-PARTY TOOLS

We rely on tools like Microsoft 365, Google Workspace, and Wix. While we aim to deliver uninterrupted service, we are not liable for downtime or service failures caused by these third-party providers.

THIRD PARTY LINKS

The Services we offer may contain links and interactive functionality interacting with third parties, including social media applications and product manufacturers' applications. Sevendesk is not responsible for and has no liability for the functionality, actions, inactions, privacy settings, privacy policies, terms, or content of any such application. Before enabling any sharing functions of the Services to communicate with any such Services or otherwise visiting any such application, Sevendesk strongly recommends that you review and understand the terms and conditions, privacy policies, settings, and information-sharing functions of each such third party application.

LIMITATION OF LIABILITY

To the fullest extent permitted by law:

  1. Sevendesk will not be held liable for any indirect, incidental, special, or consequential damages arising out of or in connection with our services.

  2. We are also not liable for any damages you may suffer caused by a cyberattack, data breach, data incident, ransomware attack and or malware attack while using the services.

  3. Our liability for any direct damages is limited to the amount paid by you for the relevant service.

UNLAWFUL OR PROHIBITED USES

The Services may only be used for lawful purposes in accordance with the terms of the license granted in these Terms & Conditions. As a condition of your use of the Services, you warrant to Sevendesk that you will not use the Services for any purpose that is unlawful or prohibited by these Terms & Conditions. violate or attempt to violate the security of the Apps and Services, including, without limitation:

    1. accessing data not intended for you or logging onto a server or an account that you are not authorized to access;

    2. trying to change the functionality of the App and Services;

    3. attempting to probe, scan, or test the vulnerability of a system or network, or to breach security or authentication measures;

    4. attempting to interfere with service to any user, host, or network, including, without limitation, via means of submitting malware to the Services, overloading, "flooding," "spamming," "mailbombing", or "crashing";

  1. tamper with the Services or use or attempt to use any device, software, routine, or data that interferes or attempts to interfere with the working or functionality of the Services or any activity being conducted on the Services;

  2. use the Services to defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights of others, including others' privacy rights or rights of publicity;

  3. harvest or collect personally identifiable information about other users of the Services;

  4. restrict or inhibit any other person from using the Services (including, without limitation, by hacking or defacing any portion of the Services);

  5. modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the Services; or

  6. remove any copyright, trademark, or other proprietary rights notice from the Services or materials originating from the Services.

INDEMNIFICATION AND DEFENSE

As a condition of the use of our Services, you agree to defend, indemnify, and hold harmless Sevendesk and its respective employees, directors, officers, agents, vendors, and suppliers from and against any liabilities, losses, investigations, inquiries, claims, suits, damages, costs, and expenses (including, without limitation, reasonable attorneys' fees and expenses) (each, a "Claim") arising out of or otherwise relating to your use of the Services we offer to you.


DISPUTE RESOLUTION

  1. Good Faith Negotiation
    In the event of any dispute, claim, or controversy arising out of or relating to the use of our services, these Terms and Conditions, or any agreement made between the user and Sevendesk IT Services Inc. (“Sevendesk”), the parties agree to first attempt to resolve the matter through good faith negotiations. Either party may initiate this process by providing written notice to the other party outlining the nature of the dispute and the desired resolution.

  2. Mediation
    If the parties are unable to resolve the dispute through negotiation within thirty (30) days of notice, either party may request that the matter be submitted to mediation. The mediation shall be conducted in accordance with the rules of a recognized mediation body in Canada, such as the ADR Institute of Canada, and will take place virtually or in Alberta (at the discretion of both parties). Each party will bear its own costs, with shared responsibility for the mediator’s fees.

  3. Arbitration
    If the dispute is not resolved by mediation within thirty (30) days from the date of commencement of mediation, the dispute shall be referred to and finally resolved by binding arbitration under the rules of the Arbitration Act of Alberta, or the applicable provincial arbitration statute. The seat of arbitration shall be Alberta, Canada, and the proceedings shall be conducted in English. The decision of the arbitrator shall be final and binding on the parties, and judgment upon the award rendered may be entered in any court of competent jurisdiction.

  4. Exceptions
    Notwithstanding the above, Sevendesk reserves the right to pursue immediate injunctive relief or equitable remedies (such as a restraining order) through the courts if necessary to prevent unauthorized use, misuse, or infringement of intellectual property, confidential information, or to protect its legal rights or the safety of its users.

  5. Time Limitation for Claims
    Any claims or causes of action arising out of or related to the use of Sevendesk’s services must be filed within one (1) year after such claim or cause of action arose; otherwise, the claim is permanently barred.

GOVERNING LAW AND JURISDICTION

By using Website, Products, App or Services, you agree that the laws of Canada without regard to principles of conflict of laws, will govern this Agreement and any dispute of any sort that might arise between you and us. For matters not subject to arbitration (as outlined above), the parties submit to the exclusive jurisdiction of the courts of Alberta, Canada.

MISCELLANEOUS

If any provision of these Terms & Conditions is held invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions will not be affected or impaired. You may not assign, transfer, or sublicense any of your rights or obligations under these Terms & Conditions without our express prior written consent. We will not be responsible for failure to fulfill any obligation due to causes beyond our control.

MODIFICATIONS TO THESE TERMS

We reserve the right to update or modify these Terms at any time. Updates will be posted on this page and become effective upon posting. Continued use of our services indicates acceptance of any changes.
